As a Legal Services Plan member, you get many Prepaid Benefits and Additional Benefits for reduced rates.

Conflict of Interest

If your Plan Attorney has a conflict of interest, you may request another Plan Attorney.

Limitation of Liability

The Legal Services Plan is not an indemnification plan. It does not reimburse any Plan Member for attorney fees or expenses.

Plan Attorneys are independent contractors and not employees of the Plan. The Plan does not assume responsibility for any act or failure to act by any Plan Attorney. The Legal Services Plan is not responsible for the substantive legal services provided by the Plan Attorney.

The Legal Services Plan does not represent or warrant that the Plan Attorney assigned to you is experienced in handling matters such as yours. Each Plan Attorney is not experienced in handling every type of potential legal issue. Thus, while the Plan Attorney assigned to you is a licensed attorney admitted to practice in your state, it is important that you consult with that Plan Attorney to determine whether he or she is qualified to handle your particular matter.

General Disclosures

The Legal Services Plan reserves the right to change or revise the Plan benefits and rates, in whole or in part, at any time.

The Plan is responsible for the administration of the Plan. Plan Members may at any time file a complaint with the State Bar or other attorney regulatory authority concerning a problem with any Plan Attorney's professional conduct.

The number of legal letters available to you under the Plan may vary. In Arkansas, Indiana, Virginia and Nebraska, the Plan Attorney will charge you $5 for each letter or phone call.

Indiana residents please note: A Legal Services Plan advisory group meets regularly to evaluate the operation of the Plan and suggest improvements. The Plan complies with Indiana Supreme Court Admission and Discipline Rule 26. However, satisfaction of the conditions under that rule shall not be construed as an approval of the Plan by the Supreme Court of Indiana.

Massachusetts residents, please note: The Massachusetts Board of Bar Overseers is the attorney regulatory authority in the state. A complaint concerning a Plan Attorney's professional conduct may be referred to the Board of Bar Overseers. Plan Members will receive a Subscriber Satisfaction Form when legal services are rendered by a Massachusetts Plan Attorney. You should return this form to the Plan with your comments, but you need not include your name.

North Carolina residents, please note: The North Carolina State Bar has approved this Plan, pursuant to N.C.G.S. Section 84-23.1(b), as being proper under the statutes, rules and regulations governing prepaid legal services plans and the practice of law in North Carolina. The North Carolina State Bar does not guarantee in any way the success of the Plan and gives no assurances of the quantity or quality of legal services to be provided. Total responsibility for the delivery of services rests with the Plan's sponsor and the Plan Attorneys in their individual attorney-client relationship.

Virginia residents, please note: You are limited to three phone calls with your Plan Attorney per month on each of no more than four legal matters. Initial office consultations at no charge are limited to four legal matters per month.

In New York, members and their spouses are each entitled to one free Simple Will and annual updates of that will.

In Arkansas, Virginia and Nebraska, residents are required to pay $15 to the Plan Attorney for one Simple Will or the initial two hours of estate planning work; there is no additional charge for updates.

Exclusions

Certain matters are excluded from your Plan Benefits:

  • Matters relating to a Plan Member's business. The Legal Services Plan is for personal and family legal services, only. For purposes of this exclusion, "business" means any activity or enterprise engaged in for gain or livelihood.
  • Any action involving the Plan, Plan Attorneys, sponsoring companies, or any of their parents or affiliates or their directors, officers, agents or employees in any matters in which they have an interest adverse to yours.
  • Frivolous matters, as determined by the Plan Attorney. Actions brought against a Plan Member are not frivolous matters.
  • Matters for which you have retained a Plan Attorney prior to joining the Legal Services Plan.
  • Matters involving the law or laws of jurisdictions other than the United States or its political subdivisions.
  • Matters in states or political subdivisions where the Plan is not available.

In matters where the Primary Member and another Plan Member from the same family have adverse interests, only the Primary Member is covered by the Plan, unless the Primary Member and affected Plan Members provide written authorization and consent otherwise.

The Plan does not pay for filing fees, court costs, expert fees, witness fees, court reporters or transcripts; nor will the Plan pay photocopying, postage, telephone or other incidental expenses incurred for, awarded to, or assessed against you.

Application and Termination

The Legal Services Plan reserves the right to reject any application for membership in the Plan for any reason whatsoever.

The Legal Services Plan may cancel your membership in the Plan if you are delinquent in paying your Plan membership. If you owe money to the Plan, you are required to pay it back, whether you are a Plan Member or not. You may cancel your membership in the Plan at any time by returning your membership cards to: Legal Services Plan, P.O. Box 5042, Carol Stream, IL 60197-5042. The Plan may cancel your membership by providing notice to you.

Corporate Entity

In the states in which The Plan is available through this Web site, the Legal Services Plan is offered by Signature Agency, Inc. Its offices are at 200 N. Martingale Road, Schaumburg, IL 60173-2096.

The Plan is only available to residents of the U.S. The Plan is not available through this Web site in AL, FL, ME, MA, MS, MT, NY, ND, OR, RI, TX, WV, WI and WY.
